01.04.2026 Serial no. 128 [G.S.D] CRM (M) 666 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Barrackpore Police Station Case No. 04 of 2025 dated 22.01.2025 u/s 126(2)/118(2)/109/3(5)/61(2) of the BNS, 2023 and 25(1-B) (a)/27/35 of the Arms Act. -And- In the matter of : Niraj Yadav @ Bally @ Balli … Petitioner(s) Mr. Mohammad Kharirul Mr. Sk. S. Ullah … for the Petitioner(s) Mr. Imran Ali Ms. Ratna Ghosh … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody since 21.02.2025 and is innocent. It is also contended that the petitioner has been implicated in connection with the instant case, as such, he may be enlarged on bail. Additionally, it is submitted that charge-sheet has already been submitted before the learned jurisdictional court; charges have been framed and the trial of the case has commenced. Learned advocate for the State opposes the prayer for bail and submits that the petitioner is a history sheeter and added that arms and ammunition were recovered pursuant to the leading statement of the present petitioner. 2 Having considered the fact that the evidence of the case is in progress and the materials available so far as the present petitioner is concerned, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(M) 666 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
