Dev, the leaned counsel for the petitioner. 2. This Miscellaneous case has been filed for restoration of Writ Petition No. 5417/2023, which was dismissed for non-prosecution on 10.11.2025. Ms. Dev, submits that when the writ petition was listed on the said date, the name of the counsel appearing for the writ petitioner was not reflected in the cause list, although, it is stated that both the Vakalatnama and additional affidavit was filed by the petitioner though the learned counsel. However, she also submits that Vakalatnama was not found in the file but the additional affidavit was there, filed by the learned counsel for the petitioner. She as such, submits that on the day when the matter was listed i.e., on 10.11.2025, the learned counsel could not appear since she had not found that the matter was listed on that day. 4. On the relevant facts and circumstances, this court deems it fit to restore Page No.# 3/3 the writ petition being WP(C) No. 5417/2023, to file in the interest of justice. 5. The Misc.
