Learned advocate appearing for the petitioner submits that the petitioner is in custody since 24.07.2024 and the subject-matter of the case relates to alleged recovery of 100 bottles of Phensedyl. So far as the present petitioner is concerned, according to the learned advocate, petitioner has been implicated on the basis of statement of co-accused. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the motorcycle which was used for carrying the contraband belonged to the present petitioner and the petitioner was evading the process of law for about 19 months. Having considered that the petitioner is in custody for 1 year 8 months and the alleged recovery in the present case 2 is of 100 bottles of Phensedyl, I am of the opinion that since there has hardly been any progress in the case since the petitioner was arrested, further detention of the present petitioner is unwarranted in the facts and circumstances of the case. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Samirul Raja Seikh @ Samirul Raja Saikh shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act-cum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 509 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
