GP FOR REVENUE The Court made the following: SRK, J W.P.No.20078 of 2026 3 O R D E R Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development, learned Assistant Government Pleader for Revenue and the learned Standing Counsel for Gram Panchayat. 2. This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in proposing to lay the road from BC Colony to the main road passing through the petitioner’s Zeroyathi land in Survey No.50-6 and 7 admeasuring Ac.0.25 cents of Vallabharayudu Village, Nandigam Mandal, Srikakulam District without following due process of law, as illegal and arbitrary and violative of petitioner’s right to property guaranteed under Article 300A of the Constitution of India and pass such other order or orders …” 3. Grievance of the petitioner is that, the petitioner’s father viz. late Sanyasi Naidu owned and possessed agricultural land in Vallabarayudu Village, Nandigam Mandal, and apart from that, he owned and possessed an extent of Ac.0.25 cents of dry land in Survey No.50/6 and 7 of Vallabarayudu Village. Subsequent to demise of his father, the petitioner, being his only son, inherited the property. The petitioner is working as Inspector of Police, Kotia Circle, Vizianagaram District. SRK, J W.P.No.20078 of 2026 4 (b) Though already there is an existing road connecting the BC Colony and the main road, the respondents were stated to have made a proposal to lay a road from BC Colony of petitioner’s village to the main road through the petitioner’s land. That when the respondents were measuring and marking in the petitioner’s land, the petitioner questioned them, for which, the respondents were said to have refused to give proper answer. The petitioner contends that the respondents have no right to trespass into the petitioner’s land and lay road without following due process of law. Hence, the Writ Petition. 4. Today, when the matter has come up before this Court, learned Assistant Government Pleader for Panchayat Raj and Rural Development Department, on written instructions received from the District Panchayat Officer, Srikakulam-3rd respondent, submits that no resolution has been passed by the Gram Panchayat concerned approving or recommending formation of road through the petitioner’s land. Learned Assistant Government Pleader further submits that the Gram Panchayat has not undertaken any proceedings relating to survey, demarcation, marking or execution of any road work over the land claimed by the petitioner. He concluded that no action has been initiated by the respondents for acquisition of petitioner’s land or for SRK, J W.P.No.20078 of 2026 5 laying any road through the land in Survey Nos.50/6 and 50/7 of Vallabharayudu Village, Nandigam Mandal, Srikakulam District, therefore, question of violation of Article 300A of Constitution of India does not arise. The written instructions are placed on record. 5. Recording the said submission, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
