This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.77/2025 registered at Police Station Kotwali, Dist. Case of the prosecution, in brief, is that complainant Sheetal Tiwari, lodged an FIR that on 08.05.2025, she and her two sons were at home. Between about 2:00 PM to 3:00 PM, they were sitting in the verandah of the house. The main door was closed but not latched. At that time, Bhuvan, Pankaj, Goldy/applicant, and others forcibly entered the house by kicking the door open. They caught hold of her son, Pratyush, saying, "Today they will kill him and finish him," and Pankaj, Goldy, and their associates held Pratyush while Bhuvan repeatedly stabbed him on his stomach and chest with a sharp knife with the intention to kill him. When they (the family members) tried to rescue him, the accused fled. Due to the stabbing, the complainant's son collapsed, covered in blood. He was immediately taken to Ambedkar Hospital for treatment. He sustained deep injuries at 3-4 places on his stomach and chest. At the time of the incident, the tenants living in her house were present and witnessed the incident. Based on the complainant's report, Crime No.77/2025 under Sections 109(2), 333, 3(5) of the Bharatiya Nyay Sanhita was registered at Police Station Kotwali, Raipur. After further investigation, Charge Sheet has been filed on 10.07.2025; U/s 109(1), 333, 338, 238, 111(2) (B) & 3(5) of Bharatiya Nyay Sanhita. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated on false and frivolous facts and the alleged incident even as per the FIR was a sudden spur of the 3 moment and the injuries alleged are not very grievous in nature. He would submit that in the same crime no. 77/2025, Co-accused Gajendra Yadav @Goldy has been enlarged on bail vide order dated 06.11.2025 bearing MCRC No. 8346/2025 and by the Sessions court, Raipur in the same crime no. 77/2025, Co- accused Pankaj Kohde has been enlarged on bail vide order dated 12.11.2025. He would submit that there are as many as 15 witnesses in the present case and as of now P.W-1 has only been cross examined and rest all are pending. He would submit that the charge sheet has been filed in this case, the applicant is in jail since 09/05/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case before the competent court. He would submit that the applicant has caused injuries to the injured by knife, his liver was found to be damaged, he had undergone a surgery. Therefore, considering the nature and gravity of the offence, applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation against the applicant that the 4 applicant has caused injuries to the injured by knife, his liver was found to be damaged, he had undergone a surgery, considering the nature and gravity of the offence, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Bhuwan Harpal involved in Crime No.77/2025 registered at Police Station Kotwali, Dist. Raipur (CG) for the offence punishable under Sections 109(1), 333, 338, 238, 111(2) (B) & 3(5) of B.N.S, is rejected. 8.
