Government Pleader for Revenue 3 BSB,J W.P.No.19838 of 2026 The Court made the following order: This writ petition is filed under Article 226 of the Constitution of India to issue a writ or order or direction, more particularly one in the nature of writ of Mandamus, in questioning the order passed by the respondent in dismissing the Appeal Case (ROR). No. 1239 / 2024 / DY.TAH (2), dated 30.03.2026 against the order of the respondent No.4 vide Rc. No. 269 / 2022 / MRI - 1 dated 07.10.2022 without mentioning the reasons for dismissing the appeal is against the Rules under the ROR Act, 1971 and U/s. 5(4) of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 ( in short ‘the Act, 1971’) for cancellation of Revenue Records, PPB / TD granted in favour of petitioners in respect of the land admeasuring an extent of Ac.0.26 cents in Sy. No. 45/13 of Chepaia Uppada village, Beemunipatnam mandal, Visakhapatnam district as illegal and arbitrary and violative of the Act, 1971 and consequently set-aside the order passed by the respondent in Appeal Case (ROR). No. 1239 / 2024 / DY.TAH (2) dated 30.03.2026 and pass such other order or orders, as this Court deems fit in the interest of justice. 02. The learned Government Pleader for Revenue placed on record a copy of written instructions of the respondent No.4 vide Rc.372 / 2026 A, dated 21.07.2026, wherein it is mainly stated that the petitioner has ex-facie statutory remedy available under the provisions of the Act, 1971, against the order passed by the appellate authority, but without availing such remedy before the Joint Collector by filing revision, this writ petition was filed. 03. In view thereof, the writ petition is disposed of granting liberty to the petitioner to avail the remedy of revision before the 4 BSB,J W.P.No.19838 of 2026 Joint Collector, Visakhapatnam within two (02) weeks from the date of receipt of the copy of this order.
