PUBLIC PROSECUTOR 2 Dr.YLR,J Crl.P.No.6400 of 2026 Dated 12.08.2026 The Court made the following: ORDER: This Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), by the petitioner/Accused No.1 seeking grant of pre-arrest bail in connection with Crime No.59 of 2026 of Adoni III Town Police Station, Kurnool District, registered for the alleged offences punishable under Sections 331(3), 324(2) and 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’), and Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2 Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The learned counsel for the petitioner submits that the petitioner/Accused No.1 has already been served with a notice as contemplated under Section 35(3) of ‘the BNSS’/Section 41-A of ‘the Cr.P.C.,’ and that, in view of the issuance of the said notice, there is no immediate apprehension of arrest to the petitioner. 3 Dr.YLR,J Crl.P.No.6400 of 2026 Dated 12.08.2026 4 Having regard to the above submission and the fact that the petitioner has already been served with a notice under Section 35(3) of ‘the BNSS’, this Court is of the view that the apprehension expressed by the petitioner does not survive for consideration at this stage. The petitioner shall comply with the terms of the notice and cooperate with the Investigating Officer in the course of investigation. 5 In view of the above, no further orders are required in the present Criminal Petition.
