The petitioner is an accused for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act, in connection with S.T. 105 of 2024, arising out of Lohardaga P.S. Case No. 117 of 2024 pending in the Court of learned Additional Sessions Judge-II, Lohardaga. 3. Learned counsel for the petitioner submits that the petitioner’s bail application was earlier rejected by a Bench of this Court vide order dated 06.10.2025 passed in B.A. No. 4555 of 2025. By way of present application, the petitioner has renewed his prayer for regular bail. It is further submitted that the petitioner is in judicial custody in connection with the present case since 08.06.2024 and there is no positive progress in the trial. Under the said circumstance, the petitioner may be given the privilege of regular bail. 4. Learned A.P.P. while opposing the petitioner’s prayer for bail submits that the petitioner’s bail application was earlier rejected by a Bench of this Court on merit keeping in view that the petitioner shot the deceased Dharmendra Kumar by his official rifle due to which he succumbed to his injuries. 5. Having heard learned counsel for the parties and considering 2026:JHHC:12772 2 that there is direct allegation against the petitioner that he shot the deceased Dharmendra Kumar by his official rifle and that the trial of the case is in progress, I am not inclined to enlarge the petitioner on bail. 6.
