Choudhury, learned Legal Aid Counsel appearing for the applicant, who submits that by filing this application, the applicant seeks for condonation of 115 days delay in filing the connected criminal appeal against the Judgment and Order dated 09.12.2025 passed by the Court of the Page No.# 2/2 Additional Sessions Judge, Bijini, Chirang in Sessions Case No. 54 of 2023. Referring to the application, the learned counsel submits that it is due to bona-fide reasons that the delay has occasioned and therefore, the delay may be condoned. Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam, fairly submits that he has no objection if the delay is condoned and that the appeal be heard on merits. In view of above, upon considering the submissions made by the learned counsel for the parties and on perusal of the application, we condone the delay of 115 days in filing the connected appeal.
