The petitioner is an accused for the offences punishable under Sections 109/61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. Though the petitioner has been named in the F.I.R., however on perusal of the written report of the informant, it would appear that the main allegation of opening fire on the informant’s son namely Md. Khurshid Ansari is against co-accused Md. Jakir Ansari @ Jaggu. It is further submitted that other similarly situated co- accused persons namely Md. Irshad Ansari @ Sonu, Md. Faiyaz Ansari @ Chhotu Ansari and Md. Aslam @ Md. Aslam Mansuri Ansari have already been granted regular bail by different Benches of this Court vide orders dated 10.03.2026, 24.03.2026 and 22.04.2026 passed in B.A. No. 1248 of 2026, B.A. No. 1406 of 2026 and B.A. No. 3352 of 2026 respectively. The petitioner is in judicial custody in connection with the present case since 03.12.2025. Hence, he may be given the privilege of regular bail.

3. Learned A.P.P. opposes the petitioner’s prayer for regular bail.
4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail.
5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Giridih in connection with Giridih (M) P.S. Case No. 373 of 2025.
