The Chief Depot Manager, Rajasthan State Road Transport Corporation, Dholpur Depot, District-Dholpur (Raj. ----Appellants Versus Pradeep Gupta S/o Shri Subhash Chand Gupta, Aged About 40 Years, R/o 224 Bhamatipura, Distt. Dholpur (Raj.). ----Respondent For Appellant(s) : Mr. R.N. Mathur, Sr. Adv. assisted by Mr. Kapil Sharma For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL HON'BLE MR. JUSTICE MANEESH SHARMA Order 12/05/2026 1. The appeal has been filed by and on behalf of Rajasthan State Road Transport Corporation (RSRTC), impugning the order dated 27.03.2026 passed by learned Single Judge in S.B. Civil Writ Petition No.5490/2026, quashing the order dated 16.01.2026 passed by the Executive Officer (Traffic), RSRTC and remanding [2026:RJ-JP:19978-DB] (2 of 2) [SAW-399/2026] the issue of placing the respondent/original writ petitioner on suspension arbitrarily to consider afresh by the Managing Director, RSRTC. 2. Learned Senior Counsel appearing on behalf of RSRTC submits that the order of suspension of respondent/original writ petitioner dated 28.10.2025 has been revoked by the Corporation itself vide subsequent order dated 28.11.2025. In that view, any detailed or reasonable order was not required to be passed, hence, the order dated 16.01.2026 was not required to be interferred with by the learned Single Judge and the impugned order warrant interference. 3. Having argued the appeal at length, learned Senior Counsel does not dispute that the legality and validity of the order of suspension dated 28.10.2025, placing the respondent/original writ petitioner on suspension, can yet be re-looked/examined by the Managing Director, RSRTC, therefore, the order of learned Single Judge is not deterimental to the interest of RSRTC, hence, he does not press this appeal to this extent, however, prays a liberty to file a fresh appeal, by and on behalf of Dr. Jyoti Chauhan the then Executive Officer (Traffic) in her personal and official capacity, to question/challenge the adverse findings recorded against her by the learned Single Judge in the impugned order. 4. In view of the above, instant appeal is disposed of with liberty, as prayed for. 5. All pending application(s), if any, shall stand disposed of. (MANEESH SHARMA),J (SUDESH BANSAL),J DEEPA-5
