2026:JHHC:12749 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 3650 of 2026 1. Jagarnath Singh, S/o Late Madan Singh 2. Bhim Singh, S/o Late Jagmohan Singh Both R/o of Village Selsoya, Bandarchunwa, PO-Barwadih, PS-Kolebira, District- Simdega, Jharkhand … … Petitioners Versus The State of Jharkhand … … Opposite Party CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Gaurav, Advocate For the State : Mr. Santosh Kr. Shukla, A.P.P. ----- Order No.02 Date: 30.04.2026 1. Heard learned counsel for the parties. 2. The petitioners are the accused for the offences punishable under Sections 18, 27(a), 28, 29 and 30 of the N.D.P.S. Act. 3. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. As per the allegation, the petitioners were apprehended while cultivating poppy. It is further submitted that the petitioners are mere labourers and were not, at all, involved in cultivation of poppy. The false implication of the petitioners would be evident from the fact that the seizure list, prepared in this regard, does not bear signature of any independent witness. The petitioners have no criminal antecedent as has been stated in paragraph-18 of the present bail application. They are in judicial custody in connection with the present case since 21.02.2026. Hence, the petitioners may be given the privilege of regular bail. 4. Learned A.P.P. opposes the petitioners’ prayer for bail. 5. Having heard learned counsel for the parties, I am 2026:JHHC:12749 2 inclined to enlarge the petitioners on bail. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act, Simdega in connection with Kolebira P.S. Case No. 09 of 2026. (Rajesh Shankar, J.) 30.04.2026 AKT Uploaded on 01.05.2026
