Upon issuance of notice, the learned AGP appears for Respondent No.1. The explanation for the delay has been set out by the Applicant in Paragraph Nos.2 and 3 of the Application. The explanation given by the Applicant appears to be satisfactory. Hence, considering the explanation tendered by the Applicant, the delay of 3477 days in filing the First Appeal is condoned, subject to the Applicant furnishing an undertaking to the satisfaction of the Registrar (Judicial) of this Court, within a period of three weeks, that the Applicant shall not claim any statutory benefits or interest for the delayed period.
