Heard Mr. B. M. Deka, the learned counsel for the petitioners and Mr. P. N. Sharma, the learned Standing Counsel for Elementary Education Department and Ms. R. B. Borah, the learned counsel for the National Institute of Open School being respondent No. 5.
2. The issue involved in these writ petitions are similar in nature and as such common order is passed disposing of all the writ petitions.
3. By these writ petitions filed under Article 226 of the Constitution of India, the petitioners have challenged the impugned notice dated 19.11.2025 as well as the subsequent notice dated 27.11.2025, whereby the petitioners were
directed to submit details relating to the HSSLC Examination and NIOS-UDISE. The petitioners have also prayed for a direction to the respondent authorities to refrain from applying the UDISE as a proof of the fact that petitioners were in
Page No.# 27/33 service as on 10.08.2017, i.e, the next date of which the amendment in Right of Children to free and Compulsory Education Act, 2009 was notified. Further, the petitioners have also prayed for their appointment as teachers against the 4,500 posts in Lower Primary (L.P.) and Upper Primary (U.P.) Schools pursuant to the Advertisement dated 08.01.2025. 4. It is the case of the petitioners, that they are holding the post of Lower Primary and Upper Primary Teachers in different private schools as well as in Govt. aided private schools within the state of Assam. While they were in service, they had obtained the 18 Months Diploma in Elementary Education pursuant to the Amendment in the Right of Children to free and Compulsory Education Act, 2009 from the NIOS. During their service tenure, an amendment was made to the Right of Children to Free and Compulsory Education Act, 2009, by way of an Amendment Act, 2017. By the said amendment, in Section 23 sub-section (2) after the second proviso, it was added, as provided below:
“ Provided further that, every teacher appointed or in position, as on the 31st of March, 2015, who does not possess minimum qualifications as laid down under sub-section (1) shall acquire such minimum qualifications within a period of four years, from the date of commencement of the Right of Children to Free and Compulsory Education, (Amendment) Act, 2017”. The said Amendment had come into force on 1st day of April, 2015, and it is provided that the teacher has to possess the minimum qualification within a period of 4 years from the said year of 2015. Although the said amendment was brought into force w.e.f. the 1st day of April, 2015 but the said amendment received the assent of the president of India on 9th of August 2017. Thereafter, by order dated 22nd of September, 2017, the National Council for Teacher Education (NCTE) had resolved that the National Institute of Open Schooling to operate study centers as per the instructions of the NHRD and that the NIOS is to complete the training of the in service teacher by 31.03.2019.
Since the Amendment was promulgated on 09.08.2017, the requirement of attaining the Diploma in Elementary Education within a period of 2 years cannot be acquired since the period between 10th of August 2017 to 31st of March, 2019, comes to around 18 months instead of 2 years and the National Council for Teacher Education by the said order dated 22nd September, 2017 had recognized the Diploma obtained within 18 months instead of 2 years for the in service untrained teachers working in Government Aided as well as in the un-aided private schools. 6. The aforesaid reduction of the mandatory training period from two years to eighteen months was challenged before the Hon'ble Supreme Court. In the Review Petition filed in 2024 arising out of Civil Appeal No. 7873 of 2023, the
Page No.# 29/33 Hon'ble Supreme Court, in “Vishwanath and Others v. State of Uttarakhand”, clarified that candidates who had obtained the 18-month Diploma in Elementary Education from NIOS would be treated as valid diploma holders for the purposes of employment in other institutions and for promotional avenues, provided that they were in service on or before 10.08.2017. 7. It is an admitted position that the petitioners in the instant petition were in service before 10.08.2017 for which they have annexed the appointment letters. Thereafter, two advertisements were issued on 08.01.2025, one for Upper Primary and one for Lower Primary for filing up of 4500 posts of teachers in both Upper Primary and Lower Primary Schools. The Petitioners being eligible under the said advertisement applied online in the Official Web site of the Education Department for the said post of Assistant Teachers and during the selection process vide notice dated 19.11.2025, the candidates were directed to submit the details of the Higher Secondary School Leaving Certificate (HSSLC) examination and NIOS-UDISE in the Official Web site of the Director of Elementary Education, Assam from 21.11.2025 to 27.11.2025.
It was also mentioned in the said notice that if the candidates failed to submit the details of the DISE Code or wrong DISE Code is submitted within the stipulated time, their candidature will be cancelled. The submissions of the particulars were however, later on extended till 01.12.2025. 8. In response to the said notice, the petitioners stated that they have duly
Page No.# 30/33 submitted the details as asked for. However, the petitioners were not appointed pursuant to the said selection process. 9. Thereafter, on 27.01.2026, Physical Document Verification was done and subsequently, on 2nd of February, 2026, also, certain verifications were done as well as on 10th of February, 2026 and after that when they did not find their names in the select list, they went and enquired in the office of the Elementary Education, wherein they were informed that the school they worked, did not have the UDISE Code, as on 10.08.2017. 10. The learned counsel for the petitioner submits that similarly situated teaches had approached this court by filing writ petition being WP(C) No. 3794/2025, wherein, similar prayer was made that demand for additional documents for verification was arbitrary and it violated Article 14 of the Constitution of India. In the instant case also the petitioners were asked to submit their UDISE along with the details of examinations. 11. The learned Single Judge in Writ Petition No. 3794/2025, had dismissed the said writ petition and the petitioners filed an intra court appeal before the Hon’ble Division Bench of this Court being W.A. No. 345/2025 and the Division Bench vide
order dated 24.03.2026 had taken note on the basis of the submission made by the Advocate General that applications of the appellants shall be verified by the
Page No.# 31/33 State and whatever documents demanded by notification dated 17.06.2025, if not produced by the appellants, the same will not be fatal and that the authorities would verify the said information from the State records/ Data base.

The notification dated 17.06.2025, was issued by the Director of Elementary Education, Assam, notifying that the candidates who had applied their online applications with 18 months Diploma in Elementary Education from NIOS against Advertisement dated 26.12.2023, were asked to attend the Physical Document Verification by carrying certain documents mentioned in the said notification and one of the document that was asked for was the UDISE code as a proof that the applicant was in service as on 10.08.2017.
13. Further it is stated that the said notification was issued in terms of the Supreme Court Judgment as mentioned above. In the instant case also while calling the petitioners for document verification, the said notification was applied, i.e., Notification dated 17.06.2025. The Hon’ble Division Bench held that the State would verify the documents furnished by the petitioners and if some documents are not found as per the notification dated 17.06.2025, the same will be verified from the State Records/Data base.
14. It is further observed that in the event of rejection of the application, the applicants shall be communicated about the reasons of such rejection.

15. Mr. P. N. Sharma, the learned counsel for Elementary Education, submits that the notice dated 17.06.2025 is issued pursuant to the Hon’ble Supreme Court’s
order in Review Petition as mentioned above. He also submits that the recruitment process for which the Hon’ble Division Bench had rendered the judgment is different from the recruitment process conducted in the instant case and also that the recruitment process initiated by Advertisement of 2025 has ended.
16. Ms. R. B. Borah, the learned counsel for the NIOS, submits that entire process of obtaining Diploma in Elementary Education was conducted through online mode and on careful perusal of the guidelines issued by the NIOS, the candidates has to apply and also that the testimonials submitted by the candidates were to be verified by the concerned Principal of the respective institutions and the said verification had to be done under the control of the Nodal Officer who has been appointed by the State Government.
17. In the instant case, it is seen that for lack of UDISE code, the petitioners were not appointed in pursuance to the Advertisement, i.e., Advertisement A & B published on 8th January, 2025.
18. It is stated by the learned counsel for the petitioner that maintaining the UDISE Code with State is a mandatory requirement but some schools had not maintained. As such, asking for such documents from the petitioners is challenged
Page No.# 33/33 in the instant writ petition. However, the state authorities can verify from the records as to whether the said exercise has been undertaken by the said schools.

In view of the conclusions reached in Writ Appeal No. 345/2025 and if the records shows that the petitioners were in service candidates as on 10.08.2017 and who have completed 18 months Diploma in Elementary Education and the school existed where they had worked as teachers, the State Authorities will consider the appointment of the petitioners to the UP & LP Schools commenced vide Advertisement dated 08.01.2025 and the exercise should be completed within a period of 2 months from the date of receipt of the certified copy of this order.
