1. Ms. Amreen Bano, learned counsel for the applicant.
2. Mr. Pratiroop Pandey, learned AGA for the State.
3. Present applicant “Dinesh Negi, son of Chandan Singh Negi,” is praying for regular bail in reference to FIR dated 19.09.2025 bearing FIR No. 0085 of 2025 registered at Police Station – Kotwali Almora, District – Almora wherein Dhirendra Singh Gailakoti, Sunil Singh Kathayat and Kapil Dhapola have been implicated for the offences punishable under Section 318 (4), 336, 338, 340 and 61 (2) BNS, 2023.

It is argued by the learned counsel for the applicant that applicant is innocent and has been falsely implicated, which is evident from the fact that he was informant and during investigation, he is made an accused. She further submits that all the offences are triable by Magistrate and the applicant is languishing in jail since 20.05.2025 and applicant has no criminal antecedent and if the applicant is enlarged on bail, he will cooperate with the investigation and will not make any attempt to temper with evidence. She further submits that co- accused Dhirendra Singh Gailakoti has been
enlarged on bail today itself in BA1 No. 1102 of
2026.

On the other hand, learned State Counsel have not disputed this fact that all the offences are triable by Magistrate and the applicant is the informant and investigation is still going on and applicant has no criminal antecedent and co- accused Dhirendra Singh Gailakoti has been enlarged on bail today itself in BA1 No. 1102 of
2026.
6. After hearing the arguments of learned counsel for the parties and taking into
consideration that all the offences are triable by Magistrate and the applicant is the informant and have no criminal antecedent and other co-accused has already been enlarged on bail, today itself this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed subject to the following condition: i. Applicant “Dinesh Negi, son of Chandan Singh Negi,” be released on bail on furnishing his personal bond and two sureties, each of the like amount to the satisfaction of the court concerned. ii. After being released on bail, applicant shall cooperate with the investigation and he will not make any attempt to induce the witnesses or temper with the evidence. iii. Applicant will not leave the country without leave of the court.
