2026:JHHC:12549 IN THE HIGH COURT OF JHARKHAND, RANCHI A.B.A. No. 1910 of 2026 ---- Dibakar Nandan @ Dibakar Nandi, aged about 54 years, son of Basant Nandan resident of Village Hathbadi, Hariajam, PO Nirsa, PS Nirsa, District Dhanbad .... Petitioner -- Versus -- The State of Jharkhand .... Opposite Party ---- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Lukesh Kumar, Advocate For the State :- Mr. Prabir Chatterjee, Advocate ---- 2/29.04.2026 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Nirsa P.S. Case No.286 of 2017, corresponding to GR Case No.4792 of 2017, for offence registered under section 413, 414 and 120B of IPC and section 30(II) of Coal Mines Act, Section 4/21 of Mines and Minerals (Regulation and Development) Act, 1957, pending in court of learned Judicial Magistrate First Class, Dhanbad. 3. Learned counsel for petitioner submits that the petitioner has earlier moved before this Case in ABA No.64 of 2018 which was dismissed by the order dated 06.04.2018 and the petitioner has earlier moved in Cr.M.P. in which interim protection was granted and subsequently, the said Cr.MP has been dismissed. 4. Learned State counsel opposes prayer and submits that no fresh ground is there for entertaining the instant anticipatory bail application as earlier the anticipatory bail application has been dismissed on merit, that too, in the year 2018. 5. Considering that the ABA no.64 of 2018 was dismissed on merit and the petitioner thereafter has obtained stay in Cr.MP which was subsequently dismissed and no fresh ground has been argued in course of argument to entertain the second anticipatory bail application, and as such, this anticipatory bail application, being A.B.A. No.1910 of 2026 is, hereby, dismissed.
