NATARAJ ORAL ORDER The petitioner herein has challenged a charge sheet filed against him for the offences punishable under Sections 341, 504, 506 and 353 of the Indian Penal Code (henceforth referred to as 'IPC') in C.C.No.5666/2020 and the consequent order taking cognizance by the I Additional Chief Metropolitan Magistrate, Bengaluru. 2. Today, the petitioner and the respondent No.2 have filed an application under Section 320 read with Section 482 of the Code of Criminal Procedure (henceforth referred to as 'Cr.P.C'). In paragraph Nos.3, 4 and 5 of the said application, it is stated as follows: - 3 - HC-KAR NC: 2026:KHC:12908 CRL.P No. 177 of 2022 "3. It is submitted that, the Petitioner and Respondent No.2 have decided to put an end to the proceedings in CC No. 5666/2020 and lead their personal life cordially and therefore the second Respondent has agreed to quash the proceedings in CC No. 5666/2020 pending on the file of Hon'ble I Addl. Chief Metropolitan Magistrate at Bengaluru, which arises out of Crime No. 245/2015 of the Halsurgate Police Station, Bengaluru for offences punishable under Sections 341, 504, 506 & 353 of the IPC and that there is no coercion or force is applied on the Respondent No.2. 4. The Petitioner/Accused submits that this compromise petition is voluntary and the petitioner/Accused will not initiate any other parallel proceedings claiming for damages, malicious prosecution etc. against the Respondent/Complainant with regard to the above matter before any court of law and agrees and undertake to that effect. 5. In view of the settlement in between Petitioner and Respondent No.2, the Petitioner has agreed to tender an unconditional apology to the Respondent No. 2 in view of the full and final settlement." 3. The petitioner and the respondent No.2 are present. Since the offences alleged are not heinous and in view of the judgment of the Hon'ble Apex Court in the case of Gian Singh v. State of Punjab - (2012) 10 SCC 303, the application is allowed and the impugned prosecution of the petitioner in - 4 - HC-KAR NC: 2026:KHC:12908 CRL.P No. 177 of 2022 C.C.No.5666/2020 pending trial before the I Additional Chief Metropolitan Magistrate, Bengaluru, is compounded.
