Heard Sri. Surendra Kumar N., learned counsel for the petitioner. 2. This petition is filed seeking a direction to the learned Additional Civil Judge and JMFC at Nelamangala (Trial Court) for the expeditious disposal of Mis. No. 6/2021 pending before the said Court. 3.
The learned counsel for the petitioner submits that the petitioner was placed ex parte in O.S. No. 220/2016. The petitioner has filed a miscellaneous application seeking to set aside the ex parte order. It is submitted that, though the said miscellaneous application was filed in the year 2021 along with an application for stay of the judgment and decree dated 18.10.2021 passed in O.S. No. 220/2016, the same has not been considered thus far. The learned counsel further submits

that a direction may be issued to the Trial Court to consider and dispose of Miscellaneous No. 6/2021 in accordance with law. 4. Having regard to the limited prayer made in the writ petition, issuance of notice to the respondents is dispensed with. The direction if issued to Trial Court no prejudice would be caused to the respondents. 5. The trial Court is directed to consider and dispose of Miscellaneous No. 6/2021, along with the application for stay, expeditiously and, in any event, not later than six months from the date of receipt of a copy of this order.
