Learned advocate for the petitioners submits that so far as the four witnesses are concerned, they could not identify the accused persons in court, as such, the learned trial court raised question in respect of the alleged recovery. Learned advocate for the State has drawn the attention of the court to the order dated 20th January, 2026 wherein the petitioner was granted liberty to renew his prayer of bail after 30th June, 2026. The quantum of seizure, in the present case, is 142 kg of ganja. Having considered the same, at this stage, I am not inclined to enlarge the petitioner on bail as timeline has already been fixed in CRM (NDPS) 1313 of 2025.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(NDPS) 459 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
