In Crl.P.No.5598/2025, the petitioner is before this Court seeking the following prayers: "Wherefore, the Petitioner most respectfully pray that this Hon'ble Court may be pleased to quash; 1) Quash the Complaint dated 20.02.2024 (Annexure-B); and Quash the FIR in Crime No.64/2024 dated 20.02.2024 (Annexure-A) registered by HSR layout PS for the alleged offences punishable under Sections 417 & 420 of IPC as against the Petitioner which is now pending on the file of Hon'ble Court of the 37th Additional Chief Metropolitan Magistrate at Bengaluru. 2) Pass such other order or orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, by allowing the instant petition, in the interests of justice and equity." 4. Heard Sri.Mohan Kumar, B.M., learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.Dileep Kumar M.K., learned counsel appearing for respondent No.2 and have perused the material on record. - 7 - HC-KAR NC: 2026:KHC:12122 CRL.P No. 5967 of 2025 C/W CRL.P No. 8009 of 2024 CRL.P No. 5598 of 2025 5. During the subsistence of the petitions, the parties to the lis have entered into a settlement and have filed applications under Section 320 read with Section 482 of the Criminal Procedure Code, 1973/Section 359 read with Section 528 of BNSS, seeking compounding of the offences. 6. In the light of the offences being the one punishable under sections 417 and 420 of the Indian Penal Code, I deem it appropriate to accept the compounding applications and terminate the proceedings against the petitioners. The affidavit filed by respondent No.2 reads as follows: "1. Mrs. Kavyashree Patel D.G, D/o Girish Desai Patel, /o Akhilkumar Padmakumar aged about 26 years, residing at No.79, 3rd Cross Gangothri Layout Ayyappa Nagar, Bengaluru- 560 035, Bengaluru City do herby solemnly affirm and state on oath as follows:- 1) I am the Respondent No.2/Informant in the above case and I am acquainted with the facts of the case Hence, I am swearing this affidavit. 2) I state that Petitioner filed the instant petition inter alia seeking quashing of (i) Complaint dated 20.02.2024; and (ii) First Information Report in Crime No.64/2024 registered by the Respondent No. 1 for the offences punishable under Sections 417, 420 of IPC now pending on the file of the Hon'ble Court of the 37th Additional Chief Metropolitan Magistrate, Bengaluru City, now called as 37th Additional Chief Judicial Magistrate, Bengaluru City. - 8 - HC-KAR NC: 2026:KHC:12122 CRL.P No. 5967 of 2025 C/W CRL.P No. 8009 of 2024 CRL.P No. 5598 of 2025 3) 1 state that on intervention of mediators and well- wishers, the Petitioner/Accused No.1 and I have reached an amicable settlement of the matter, agreed and prepared to compromise the case in Crime No.64/2024 and I agreed to withdraw the Impugned Complaint by filing necessary application under Section 320 read with Section 482 of Cr.PC along with joint affidavits. 4) I, ie., 2nd Respondent confirms that in view of the settlement arrived between me and the Petitioner there are no subsisting disputes between us with respect to allegations made in the Complaint. Further, I hereby withdraw all the allegations made against 1st Petitioner and other Accuser persons and confirm that I do not have any objection for the quashing of: a. The Complaint dated 20.02.2024 filed by me with the 1st Respondent HSR Lay-Out Police Station against the Petitioner and others; and b. The First Information Report dated 20.02.2024 bearing Crime No.64/2024 registered by the 1st Respondent HSR Lay-Out Police Station and now pending on the file of the Hon'ble Court of 37th Additional Chief Judicial Magistrate, Bengaluru City. 5) I state that the Petitioner and other Accused persons have paid a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) by way of Demand Draft bearing No.2747012100105, drawn on Axis Bank, Polayathodu Branch, dated 19.02.2026 in my favour as full and final settlement of all my claims and I have received a DD towards the full and final settlement. 6) I state that with the intervention of mediators and well-wishers, the Petitioner and I have reached an amicable settlement of the matter, agreed and prepared to compromise the case in Crime No.64/2024. 7) I and the Petitioner and other Accused persons acknowledge that in view of the settlement arrived at between us, neither Party has any subsisting claims or allegations against each other in respect allegations made in the Complaint. 8) I agree and confirm that in consideration of this settlement acknowledges that the Disputes between the Parties are fully settled and that I shall not bring or file - 9 - HC-KAR NC: 2026:KHC:12122 CRL.P No. 5967 of 2025 C/W CRL.P No. 8009 of 2024 CRL.P No. 5598 of 2025 any civil suit or any other claim whatsoever, of civil nature or any other proceedings related to the Disputes, in any manner whatsoever, against the Petitioner, other Accused in Crime No.0064/2024 & HDFC Bank. 9) That it is a fit case where this Hon'ble Court may be pleased to grant permission to compromise and compound the case under Section 320 and Section 482 of Cr. P.C and Section 359 and Section 528 of BNSS. 10) I have no objection for allowing the above case and also quashing of the case in Crime No.64/2024. No prejudice will be caused to the Respondent No.1 Police or to any person if the instant Petition is allowed as prayed for. 11) I hereby confirm that affidavit filed in support of the case of the Application and also for Compromise Application are out of my free and voluntary will and accord and there is no undue influence, pressure or threat or force on me from Petitioner or from any third parties. 12) I state that no prejudice will be caused to the Respondent No.1 Police or to any person if the instant Petition is allowed as prayed for. 13) I have read over the compromise Application and understood the effect or the consequences of compromise and I have affixed my signature before the Notary Advocate I Mrs. Kavyashree Patel D.G, state that this my name and signature and the contents of this affidavit are true and correct to the best of my knowledge, information and belief" 7.
