The instant bail application has been filed by the petitioners -Shabu Barman Son Of Aneshwar Barman and Harish Bhai Chaman Bhai Rawal, aged about 40 Years and 37 years respectively, arrested in connection with FIR No.108/2026, dated 29.04.2026, Police Station Transport Nagar [Jaipur City (East)], District Jaipur City (East), for the offences under Sections 8 and 20 of N.D.P.S. Act. [2026:RJ-JP:21577] (2 of 3) [CRLMB-7299/2026] 2. Learned counsel for the petitioners submits that the alleged contraband recovered from the petitioners, namely ganja, is less than the commercial quantity i.e. 6 kg. 13 g., whereas the prescribed commercial quantity is 20 kgs.. It is further submitted that the petitioners have no criminal antecedents of any nature. Therefore, he prayed that the accused petitioners may be enlarged on bail. 3. Learned Public Prosecutor has opposed the bail application. 4. Considering the overall facts and circumstances of the present case, particularly the fact that the petitioners have no criminal antecedents, as observed by the learned trial Court and the alleged contraband recovered is less than the commercial quantity, and without commenting upon the merits or demerits of the case, this Court deems it just and proper to grant bail to the accused-petitioners. 5. Accordingly, the bail application filed under Section 483 BNSS is allowed and it is directed that accused-petitioners Shabu Barman Son Of Aneshwar Barman and Harish Bhai Chaman Bhai Rawal shall be released on bail in connection with FIR No.108/2026, dated 29.04.2026, Police Station Transport Nagar [Jaipur City (East)], District Jaipur City (East), provided both of them executes a personal bond in a sum of Rs.1,00,000/- along with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of the learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioners are further directed not to take undue advantage of liberty or misuse [2026:RJ-JP:21577] (3 of 3) [CRLMB-7299/2026] the liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. 6. The petitioners shall also mark their presence before the concerned SHO of the Police Station twice a month for the entire period of the trial. The SHO shall maintain register to mark presence of the petitioners. In case the petitioners fail to appear twice in any month then the same shall be considered as breach and this bail shall stands canceled automatically without further reference to the Court. 7. It is further directed that in case, the petitioners are found to be involved in any case of NDPS Act during pendency of the trial in this case, learned Public Prosecutor shall file an application for cancellation of this bail, without any fail.
