Kausik (Allowed) CRM (NDPS) 499 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Balurghat Police Station Case No. 484 of 2025 dated 18.07.2025 under Sections 21(c)/22(c)/23(c)/27A/29 of the NDPS Act. And In the matter of : Bapi Hembram & Anr. ……Petitioners. Mr. Kaushik Choudhury Mr. Dwipayan Panda ……for the Petitioner. Ms. Faria Hussain, Ld. APP Ms. Baishakhi Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about 8 months and the subject matter of the case relate to alleged recovery of 100 bottles of Fairdyl from the joint possession of the petitioners. Learned advocate for the State opposes the prayer for bail. I find that charge sheet has already been submitted and the prosecution has relied upon 13 witnesses in order to prove its case, some time will be consumed for taking the trial to its logical conclusion. As such, I am of the view that further detention of the petitioner is unwarranted. 2 Accordingly, the prayer for bail of the petitioners is allowed. Accordingly, Petitioners, namely, (1) Bapi Hembram, (2) Satya Murmu shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act) cum- ADJ, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, petitioners shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 499 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
