JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in SC No.114/2020 (Crime No.17/2020 of Yagati Police Station) registered for offences punishable under Sections 504, 323, 436 and 307 read with Section 34 of IPC pending on the file of the learned Principal District and Sessions Judge, Chikkamangaluru. 2. Heard the learned counsel for petitioner and the learned High Court Government Pleader for respondent/State. - 3 - HC-KAR NC: 2026:KHC:8239 CRL.P No. 17013 of 2025 3. The petitioner was granted bail at a crime stage on 08.07.2020. Thereafter, charge sheet has been filed and case has been registered against the petitioner in SC No.114/2020. In the said sessions case, the petitioner was granted bail on 18.02.2022. Thereafter he remained absent on 05.02.2024 and NBW was issued against him. The bail was cancelled by order dated 05.02.2024. Subsequently the bail bond executed by the petitioner was forfeited on 19.08.2025. Thereafter, the petitioner surrendered before the Court on 14.11.2025 and has been in judicial custody since then. 4. The petitioner has now deposited forfeited bond amount of Rs.50,000/- on 03.02.2026 before the Trial Court in SC No.114/2020. It is submitted that the petitioner could not appear before the Trial Court due to miscommunication between him and his counsel. The petitioner has undertaken to appear before the Trial Court and abide by any conditions to be imposed by this Court. - 4 - HC-KAR NC: 2026:KHC:8239 CRL.P No. 17013 of 2025 5. Considering the above facts, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER i) The petition is allowed. ii) The petitioner is granted bail in SC No.114/2020 (Crime No.17/2020 of Yagati Police Station) registered for offences punishable under Sections 504, 323, 436 and 307 read with Section 34 of IPC pending on the file of the learned Principal District and Sessions Judge, Chikkamangaluru subject to following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. - 5 - HC-KAR NC: 2026:KHC:8239 CRL.P No. 17013 of 2025 c) The petitioner shall attend the Trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case.
