In this writ petition, the petitioner has sought the following reliefs: a) Issue appropriate Writ directing the Court of the II Additional Senior Civil Judge and J.M.F.C, Anekal to expeditiously conduct trial and dispose the O.S. No. 1052 / 2007 pending on its file within 01 year from the date of passing of the said direction by this Hon'ble Court; Annexure: A, b) Pass any other or further Orders as this Hon'ble Court deems fit in the facts and circumstances of the case in the interest of justice. - 5 - HC-KAR NC: 2026:KHC:13996 WP No. 6345 of 2026 2. For the sake of convenience, the parties are referred to as per their ranking before the Trial Court in the Original Suit. 3. The plaintiffs filed a suit in O.S.No.1052/2007 before the Trial Court seeking the relief of declaration of title. Despite the lapse of about 18 years, the suit has not yet been disposed of. On an earlier occasion, the petitioner had approached this Court in W.P.No.8997/2021. This Court, by order dated 17.08.2021, passed the following order: “However, it would suffice for this Court to dispose of this petition observing that the detailed guidelines have been issued for expeditious disposal of the older matters and the civil court must take every such measure as would be necessary for compliance with such directions. The petition stands disposed of accordingly.” 4. In view of the above circumstances, and without expressing any opinion on the merits of the case, this writ petition is disposed of. - 6 - HC-KAR NC: 2026:KHC:13996 WP No. 6345 of 2026 5. The Trial Court is directed to dispose of the suit as expeditiously as possible, and in any event not later than eighteen (18) months from the date of receipt of the certified copy of this order, provided there is no order of stay of the said proceedings in any Court of law.
