22.04.2026. 1. The letter petition submitted by Mr. Sudershan Mehta, retired Deputy Superintendent of Police, was received by the Secretariat of the Chief Justice seeking immediate intervention against illegal and unauthorized construction being carried out on Plot No. 105-P, Sector No. 4, Roop Nagar Housing Colony, Jammu. The same was treated as a writ petition in public interest and registered as WP(C) PIL No. 2/2026. 2. Notice was issued to Sh. Sudershan Mehta, and Ms. Monika Kohli, learned Sr. AAG, was requested to examine the matter and seek instructions from the Jammu Municipal Corporation. 3. Ms. Monika Kohli, learned Sr. AAG has produced communication dated 07.04.2026 addressed to her by the Jammu Municipal Corporation wherein it is stated that an offline application was received from Sh. Rajeev Gupta seeking compounding/ regularization of additional construction raised at his premises. It is further stated that pursuant to the receipt of the aforesaid application, the nature and extent of deviations have been duly recorded by the enforcement staff in accordance with the relevant position of Building Bye laws. granting building permission as well as regularization is carried out strictly through online mode in the Jammu Municipal Corporation. Offline submission of application is not permissible and after the receipt of the online application, the same shall be processed and appropriate decision shall be taken within a period of 30 days and the request for compounding/ regularization shall be considered subject to removal of non-compoundable violations, if any, and payment of prescribed compounding fee & fulfillment of all codal formalities. 4. Ms. Monika Kohli, learned Sr. AAG, submitted that the online portal of the Jammu Municipal Corporation is presently not functioning, and that as and when the online application is submitted by Sh. Rajeev Gupta on the portal of JMC, the same shall be considered in accordance with law. 5. In view of the categoric stand taken by the Jammu Municipal Corporation, we do not find any reason to keep the present petition pending. Accordingly, the proceedings in the instant petition are closed with an observation that, once the online portal of the Jammu Municipal Corporation becomes functional, any application submitted by Sh.
Rajeev Gupta for regularization/compounding of the additional construction raised at his premises shall be considered by the respondents strictly in accordance with the applicable laws and rules. (Rajnesh Oswal) (Arun Palli) Judge Chief Justice
