The petitioners are apprehending their arrest in connection with Jainagar P.S. Case No.174 of 2025 for the alleged offences registered under Sections 126(2), 115(2), 117(2), 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned S.D.J.M., Koderma. 3. Learned counsel appearing for the petitioners submits that petitioner No.1 is own brother of the informant and petitioner No.2 is son of petitioner No.1. He further submits that both the brothers are running a petrol pump in partnership and due to partnership certain dispute is there and for altercation petitioner No.1 has lodged the FIR being Jainagar P.S. Case No.176 of 2025. He then 2026:JHHC:12502 --2-- A.B.A. No. 1849 of 2026 submits that this is a counterblast case of the said case. He next submits that it has come that injury is simple in nature. He also submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.21 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that allegation of assault are there. 5. Considering that petitioner No.1 is own brother of the informant and petitioner No.2 is son of petitioner No.1 and petitioners have got no criminal antecedent as disclosed in paragraph No.21 of the petition and there are case and counter case and the altercation took place due to dispute in partnership business of petrol pump and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
