The Court made the following Order:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the execution of the works.
The grievance of the petitioner is with regard to the action of the Respondents in withholding the payment of the pending amounts of Rs.26,61,863/- (Rupees Twenty-Six Lakhs Sixty-One Thousand Eight Hundred and Sixty-Three only), even after finalization of the bills payable to the Petitioner in respect of the following works, namely: (i) Engaging of JCB at Allipuram Dumping Yard and engaging of JCB and breaker at Collector Bungalow, Lassi Center and Narthaki Center for removal of encroachments at Nellore Municipal Corporation, under Agreement No.409B/EE/JTO-I/2025-26, dated 15.10.2025, for an amount of Rs.3,26,665/- ; (ii) Providing Chalivendram at Old Municipal Office, Munimudi Bus Stand, Santhapet Market and Bosubomma in Nellore Municipal Corporation, under Agreement No.DB-11/236/24-25, dated 18.03.2025, for an amount of Rs.4,97,513/-; (iii) Engaging a tractor for removal of silt under Sanitary Supervisor-3 and Sanitary Supervisor-4 in Nellore Municipal Corporation, under Agreement No.204/JTO-II/2025-26, dated 28.06.2025, for an amount of Rs.4,95,600/-; (iv) Engaging hydraulic crane, JCB and tractors for removal of scrap, debris and jungle at the Nellore District Court in Nellore Municipal Corporation, under Agreement No.380/EE/JTO-II/2025-26, dated 27.09.2025, for an amount of Rs.3,53,317/-; (v) Supply and delivery of fixing mike sets to private garbage tractors in the Rural Constituency of Nellore Municipal Corporation, under Agreement No.184/JTO-II/2025-26, dated 23.06.2025, for

an amount of Rs.4,94,631/-; and (vi) Supply and delivery of fixing mike sets to NMC vehicles in Nellore Municipal Corporation, under Agreement No.193A/JTO-II/2025-26, dated 26.06.2025, for an amount of Rs.4,94,137/-. 2. It is submitted that the petitioner had completed the works entrusted to him and that the competent authority of the respondents had also approved the payment due and payable to the petitioner. The respondents have also recorded the progress of the works and the amounts due and payable to the petitioner in the M-Book. 3.
Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri V. Naga Praveen, learned Standing Counsel for the respondent Municipality, and the learned Assistant Government Pleader for Finance and Planning. 4. During the course of hearing, the learned Standing Counsel appearing for the respondent Municipality submits that the works have been completed and that the petitioner has also submitted the final bills and the amounts due and payable to the petitioner have been duly admitted. It is submitted that further funds are awaited and that, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared. 5. Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably

within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 6. Pending miscellaneous petitions, if any, shall stand closed. ____________________ JUSTICE HARINATH.N 11.08.2026 RSD
