It transpires from the record that the applicant is in jail since 01/09/2025. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.0102/2025 registered at Police Station Divisional Flying Squad, Excise Circle Ambikapur, District Sarguja CG for the offence punishable under Section 22(C) of the NDPS Act. 4. Case of the prosecution, in brief, is that on 01.09.2025, the Officers of Divisional Flying Squad, Excise Circle Ambikapur, District Sarguja CG has seized 10 units of Rexogesic (Buprenorphine Injection IP): 2 ml each, totaling 20 ml and 10 units of Avil (Pheniramine Maleate Injection IP): 10 ml each, totaling 100 ml from the illegal possession of the present Applicant. On the same day, the applicant was arrested in connection with the commission of an Offence punishable under Section 22(C) of the NDPS Act. 5. Learned State counsel opposes the bail application and submits that charge sheet has been filed in this case before the competent court. He would submit that the applicant has no criminal antecedents. He would further submit that the contraband article which is said to have been recovered from the applicant i.e. 20 ml which is commercial quantity, therefore, this bail application is 3 liable to be rejected. 6. I have perused the case diary. 7. From the perusal of the record, it goes to show that the contraband article which is said to have been recovered from the applicant i.e. 20 ml is commercial quantity, therefore this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the bail application of applicant Prince Gupta involved in Crime No.0102/2025 registered at Police Station Divisional Flying Squad, Excise Circle Ambikapur, District Sarguja CG for the offence punishable under Section 22(C) of the NDPS Act, is rejected. 9.
