The petitioner is an accused in the case registered for the offences punishable under Sections 331(4) & 303(2) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. The petitioner has not been named in the F.I.R. He has been implicated in the present case on the basis of alleged confession. There is no other cogent material to connect the petitioner with the alleged offence. There is no recovery of the stolen ornaments/articles from the possession of the petitioner. The petitioner has filed a supplementary affidavit stating that though there are 18 other criminal cases pending against him, however, he has been granted regular bail in 7 of those, whereas he has not been remanded in rest of the cases. So far as the present case is concerned, the petitioner has been implicated without any cogent material. The petitioner is in 2026:JHHC:12782 2 judicial custody since 07.10.2025. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. The petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bermo at Tenughat in connection with Gomia P.S.
