The affidavit of service filed today is taken on record. 2. The petitioner is the son of a former employee in the Sundarban Janakalyan Sangha Vidyaniketan (HS), who expired sometime in January 2024. The erstwhile employee was an Assistant Teacher left the petitioner as one of his legal heirs and representatives. The petitioner being a handicapped son of the former employee, claims entitlement to the pensionary benefits of his father. 3. According to the petitioner, the other children are disentitled and he alone is entitled to the family pension as he is a physically crippled/disabled child of the erstwhile employee. 4. The petitioner seeks his entitlement on the basis of the Memorandum No. 10-SE(B) dated January 13, ----------------------------- O//M-131/2008 (Part-I) 2009, which entitles family pension for life to 2 children with disabilities or both mental and physical of the teaching and non-teaching staff of the non-Government Educational Institutions. The petitioner’s father being employed in such an institution and the petitioner being a person with disability, thus, seeks entitlement of the pension. 5. The respondent no. 3 is directed to consider the question of eligibility of the petitioner to receive the family pension as well as the quantum thereof. Such decision will be taken by June 30, 2026 and will be intimated to the petitioner within a week therefrom. If found eligible, the requisite Pension Payment Order in favour of the petitioner will be issued by July 15, 2026. 6. With the afore-stated directions, the writ petition is disposed of. 7.
