Also heard Mr. P Sarma, Learned Standing Counsel, Department of Fisheries, Assam, appearing for the Respondent No. 1, 2, 3 & 4 and Mr. J Chutia, Learned Government Advocate, appearing for Respondent Nos. 5, 6 & 7. The Petitioner, in the present Writ Petition, has prayed for a direction upon the Respondent authorities for a recasting of the annual value of the Kakorikata Beel of Majuli district, commensurating to the reduction of the area of the Beel from 70 hectare to 25.73 hectare. The Petitioner has also prayed for a Page No.# 3/5 direction upon the Respondent authorities to demarcate the area of the Beel, by opening the channel for ingress and egress of the Beel. Mr. P Sarma, Learned Standing Counsel, Department of Fisheries, Assam, submits that the Petitioner, having satisfied himself with regard to the condition of the Beel, after duly inspecting it before submission of his bid, he cannot be, now, permitted to make prayer for a recasting of the revenue, required to be deposited by him, for operating the same. Mr. H Das, Learned Counsel for the Petitioner, fairly submits that the Petitioner would not be pressing the prayer made in the present Writ Petition and would only press the prayer for a demarcation of the Beel. Accordingly, Mr. H Das, Learned Counsel for the Petitioner submits that the present Writ Petition be disposed of, directing the jurisdictional Deputy Commissioner, to carry out a demarcation of the Beel area. Mr. J Chutia, Learned Government Advocate, submits that the process for demarcation of the Beel area, was initiated, however, the same could not be completed, as there was a discrepancy Page No.# 4/5 with the claim made, with regard to the area of the Beel, by the Petitioner, the Assam Fisheries Development Corporation Ltd. and the area of the Beel, as recorded in the land records. In view of the above submissions made by the Parties to the proceeding, this Court directs the jurisdictional Deputy Commissioner, to carry out the demarcation of the Beel, by adhering to the area of the Beel, as reflected in the land records, maintained in this connection. The Petitioner, as well as the authorities of the Assam Fisheries Development Corporation Ltd., shall extend full cooperation to the District Administration, in the matter, so as to ensure early conclusion of the process of demarcation. On the demarcation being effected, appropriate communication, in this connection, be issued by the district authorities to the Assam Fisheries Development Corporation Ltd., who in turn shall communicate the same to the Petitioner, herein. The said exercise be initiated within a period of 15 (Fifteen) days from the date of receipt of a certified copy of this order and completed within a period not later than 2 (Two) months, thereafter.
