JUSTICE KALYAN RAI SURANA ORDER Date : 05.06.2026 Heard Mrs. R. Choudhury, learned senior counsel, assisted by Ms. B. Hazarika, learned counsel for the petitioners and Mr. B.J. Mukherjee, learned counsel for the respondent nos. 1 to 16. None appears on call for the remaining respondents. 2. The petitioners are third parties to the proceedings in T. Ex. Case No. 10 of 2021, which has been filed for execution of the judgment and decree dated 21.12.2020, passed by the learned Civil Judge (Junior Division), North Salmara, Abhayapuri, in T.S. No. 43 of 2017. 3. The petitioners, claiming independent right, title, and possession over the decretal land, had filed an objection in the execution proceedings under Order XXI Rules 97, 98, and 101 read with Section 151 of the Code of Civil Procedure, which was registered as Petition No. 1342 of 2022. 4. The learned Civil Judge (Junior Division), North Salmara, Abhayapuri, by order dated 13.08.2024, rejected Petition No. 1342 of 2022 on the ground that the petitioners had not produced a copy of the registered sale deed to prove their title over the suit land. 5. In terms of Rule 103 of Order XXI of the Code of Civil Procedure, any adjudication made on an application under Rule 98 or Rule 100 of Order XXI Page No.# 7/8 shall have the same force and shall be subject to the same conditions as to an appeal or otherwise as if it was a decree. 6. As per the definition of “decree” as provided under Section 2(2) of the Code of Civil Procedure, the rejection of plaint would also be deemed to be a decree. Therefore, as the objections made under Order XXI Rules 97 would entail questions to be determined under Rule 101 of Order XXI and the questions are determined would be one within the meaning of Rule 98 of Order XXI, which according to Rule 103 would be a decree and the rejection of an application would also amount to a decree, ordinarily an appeal would lie against the order dated 13.08.2024 impugned in this application. 7. Accordingly, the learned senior counsel for the petitioners seeks leave of the Court to permit her to withdraw the present application with liberty to approach the appropriate Court by filing an appeal. 8. The prayer is considered and allowed. 9. Accordingly, the application stands dismissed as withdrawn, with liberty to approach the appropriate Court having jurisdiction. 10. It is thereby provided that since the present application was filed on 06.06.2025, and therefore, if the appropriate application is filed within a period of one month from the date of the order, the time spent between 01.06.2025 till one month from the date of this order shall be treated as time spent before this Court bona fide and the petitioner would be entitled to claim benefit under Section 14 of the Limitation Act for period as indicated above. 11. Accordingly, this application stands closed with liberty as granted Page No.# 8/8 above. 12. The interim order dated 13.10.2025, staying the proceedings of Title Execution Case No. 10 of 2021, stands vacated. 13. The records of Misc.(J) Case No. 22 of 2022, which has been called for from the Court of the learned Civil Judge (Junior Division), North Salmara, Abhayapuri, shall be returned by the Registry forthwith. 14.
