JUSTICE M.I.ARUN - 4 - HC-KAR NC: 2026:KHC:15320 WP No. 3712 of 2026 ORAL ORDER The petitioner made a request to the Mangalore City Corporation [respondent No. 2] to correct the name of her parents in her Birth Certificate and the same has been rejected. Aggrieved by the same, the present writ petition is filed. 2. Section 15 of the Registration of Births and Deaths Act, 1969 [for short, 'the Act'] reads as under. "15. Correction or cancellation of entry in the register of births and deaths.— If it is proved to the satisfaction of the Registrar that any entry of a birth or death in any register kept by him under this Act is erroneous in form or substance, or has been fraudulently or improperly made, he may, subject to such rules as may be made by the State Government with respect to the conditions on which and the circumstances in which such entries may be corrected or cancelled, correct the error or cancel the entry by suitable entry in the margin, without any alteration of the original entry, and shall sign the marginal entry and add thereto the date of the correction or cancellation. - 5 - HC-KAR NC: 2026:KHC:15320 WP No. 3712 of 2026 3. Under the circumstances, the jurisdictional Registrar, Mangalore City Corporation is required to make an enquiry as contemplated under Section 15 of the Act and take appropriate decision. The impugned Endorsement at Annexure - D1 to the writ petition is contrary to it as no such enquiry as contemplated by law has been made. Hence, the following. ORDER [a] The writ petition is hereby disposed of. [b] The impugned Endorsement at Annexure - D1 dated 19.09.2025 is hereby set aside. [c] The matter is remanded back to the jurisdictional Registrar, Mangalore City Corporation. [d] The petitioner shall appear before the jurisdictional Registrar, Mangalore City Corporation on 15.04.2026 without further notice and after making an enquiry as contemplated by Section 15 of the Act along with the Rules applicable, the jurisdictional Registrar, Mangalore City Corporation shall - 6 - HC-KAR NC: 2026:KHC:15320 WP No. 3712 of 2026 pass appropriate orders in accordance with law in respect of the request of the petitioner.
