Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 25.4.2026 1) By way of this petition, the petitioner has sought following reliefs:- “10.1 That the Hon'ble High Court may kindly be pleased to call for entire records pertaining to the case of petitioner for kind perusal of this Hon'ble Court. 10.2 That the Hon'ble High Court may kindly be pleased to direct the respondent i.e. CEO Janpad Panchayat Kota and allow the petitioner to be appointed as assistant Teacher Panchayat taking into consideration of the experience of Guruji in Janbhagidari Shikshak whish has been counted by the Hon'ble court while passing the identical order. 10.3 That the Hon'ble High Court may kindly be pleased to direct the respondent i.e. Assistant Programme Officer of the Mahatma Gandhi MNREGA of District Panchayat Bilaspur be directed not to pass any order regarding the show cause notice on the basis of complaint made by Rajesh Singh Raj, Sarpanch, of Gram Panchayat Bhaisajhar. 10.4 Any other relief, which may be deemed, fit by this Hon'ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner.” 2) Learned counsel for the petitioner would submit that the petitioner served as a Teacher in a Jan Bhagidari School for three years. He was not extended experience marks according to the notification issued by the Panchayat and Rural Development Department, State of Chhattisgarh dated 6.10.2006. He would contend that the petitioner made a representation before the Chief 3 Executive officer, Janpad Panchayat, Kota pursuant to order passed in WP(S) No.9926 of 2019 dated 29.11.2019 but same has been rejected vide order dated 11.3.2020 only on the ground that there is no provision to grant bonus marks to Jan Bhagidari Teacher. He would submit that such finding is contrary to the notification dated 6.10.2006. He would pray to quash the order dated 11.3.2020. 3) On the other hand, learned counsel appearing for the respondents would oppose. They would submit that the petitioners did not submit the relevant documents before the authority concerned to substantiate that he was a Teacher at Jan Bhagidari School, therefore, the representation made by the petitioner was rejected. 4) I have heard learned counsel for the parties and perused the documents placed on record. 5) A perusal of Annexure-P/1 dated 11.3.2020 would show that the representation of the petitioner was rejected on the ground that there is no provision to extend experience marks to Teachers who worked in Jan Bhagidari School. The findings arrived at by the Chief Executive Officer, Janpad Panchayat Korba appears to be erroneous. It further appears that the said authority has passed the order without due application of mind. As the authority failed to consider the notification dated 6.10.2006, the order Annexure- P/1 dated 11.3.2020 is hereby quashed. Respondent No.4 is directed to reconsider the claim of the petitioner afresh in light of 4 circular dated 6.10.2006.
