2026:JHHC:12784 - 1 - IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 2361 of 2026 1. Sanjeet Giri @ Sanjit Giri, son of Late Laxmi Giri, resident of Indarpuri Colony, Bari Yusufpur, Hajipur, District- Vaishali (Bihar) 2. Anshutosh Raj @ Anshutosh H. Giri, son of Shailendra Giri, resident of Bhagwanpur, P.O. & P.S.- Hajipur, District- Vaishali (Bihar) … … Petitioners Versus The State of Jharkhand …. … Opp. Party CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR For the Petitioners : Mr. Anil Kumar, Sr. Advocate Ms. Chandana Kumari, Advocate For the State : Mr. Gautam Rakesh, A.P.P. 04/30.04.2026 The petitioners are accused for the offences punishable under Sections 126(2)/127(2)/ 331(5)/ 115(2)/ 117(2)/ 109(1)/ 351(2)/352/3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Learned senior counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. The petitioners have been roped in the present case due to personal grudge of the informant. In fact, there had been an agreement between the informant as well as the petitioner no. 1 and his brother- Ranjeet Kumar Giri. Out of the said agreement, an amount of Rs.42,00,000/- was given to the informant for construction of a village resort. The said amount was however not returned by the informant with an intent to grab the said money, rather he has implicated the petitioners with a false allegation that they assaulted him along with three other co-accused persons. It is further submitted that even if the content of the written report is taken to be true, no specific overt act has been alleged against the 2026:JHHC:12784 - 2 - petitioners, rather there is general and omnibus allegation against all the five accused persons including the petitioners. The petitioners are in judicial custody in connection with the present case since 20.01.2026. Hence, they may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioners’ prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioners on bail. 5. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Jamshedpur in connection with Bodam P.S. Case No. 09 of 2026. (Rajesh Shankar, J.) April 30, 2026 Ritesh Uploaded on 01.05.2026
