JUSTICE SAMEER JAIN Order 18/03/2026 1. The instant bail applications have been filed under Section 483 BNSS on behalf of accused-applicants. The accused-applicants were arrested in connection with FIR No. 186/2025 registered at Police Station Gangdhar District Jhalawar for the offence(s) under Section 8/15 of NDPS Act and the learned Trial Court amidst the [2026:RJ-JP:11616] (2 of 3) [CRLMB-1917/2026] offences under Sections 8/15, 8/29 of NDPS Act dismissed the bail applications before it. 2. In the connected application, it is submitted by learned counsel for the accused-applicants that the matters pertain to NDPS Act wherein alleged quantity recovered is 30 Kgs of poppy husk, which is less than commercial quantity i.e. 50 Kgs. It is submitted that the applicant- Vijay Singh is in custody since 13.01.2026 and the applicant- Chanan Singh is in custody from a period of six months. It is submitted that charge-sheet is already filed. 3. Per contra, learned Public Prosecutor has opposed the instant bail applications. It is submitted that the applicant- Chanan Singh is having seven criminal antecedents of similar nature registered against him. It is also submitted that the applicants are social threat to the society as they are habitual to commission to such offence. 4. Upon the same, learned counsel for the applicant- Chanan Singh has submitted that the antecedents which are recorded pertain to recoveries of small quantities. It is also submitted that applicants are ready to abide condition of staying 250 Kms away from the current place of residence as well as place of work for a period of six months, if imposed. 5. Heard and considered. 6. Considering the overall facts and taking note of the fact that alleged quantity recovered is 30 Kgs of poppy husk, which is less than commercial quantity i.e. 50 Kgs; that the applicant- Vijay Singh is in custody since 13.01.2026 and the applicant- Chanan Singh is in custody from a period of six months; that charge-sheet [2026:RJ-JP:11616] (3 of 3) [CRLMB-1917/2026] is filed, but without commenting upon the merits/demerits of the case, this Court is inclined to enlarge the accused-applicants on bail with following conditions:- 6.1 That the applicants will go for their employment/work and reside 250 kms away from the place of their current residence for a period of six months as the applicants are habitual to commission of such offence. 6.2 That on every 5th of successive month, applicants will mark attendance before the jurisdictional police station. 6.3 That the concerned SHO of the present place of posting will file cancellation applications if the undertaking given by the learned counsel for the applicants are not complied with regard to change of residence for the appropriate period. 7. Accordingly, the bail applications under Section 483 BNSS are allowed and it is ordered that accused-applicants Vijay Singh @ Baje Singh S/o Shankar Singh & Chanan Singh S/o Gurucharan Singh shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- each, with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. 8.
