Case No.135 of 2025 dated 06.03.2025 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the NDPS Act, 1985. Learned counsel for the petitioner submits that other than the statement of a co-accused, there is no material available against the present petitioner. Learned counsel for the State opposes the prayer for anticipatory bail, relies on the case diary and the report and submits that there are two criminal antecedents against the petitioner, both involving offences under the NDPS Act. The allegation in the present case is that the petitioner was present at the spot, but managed to flee after the raid was conducted. Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected. Presence of the investigating officer is noted and is dispensed with.
