Janmejay --Petitioner Versus State of Uttarakhand and others
--Respondents
Hon’ble Manoj Kumar Tiwari, J.
Mr. Gaurav Pawar, Advocate, holding brief of Ms. Prabha Naithani, Advocate for the petitioner.
2. Mr. Sudhir Kumar Nailwal, Standing Counsel for the State of Uttarakhand.
3. Petitioner contends that he moved an application for demarcation under Section 41 of Land Revenue Act before the Tehsildar, Haridwar, on 16.05.2026, however, no decision has been taken thereupon.
4. Learned State Counsel, however, submits that the writ petition is misconceived, as petitioner should have made application to the Assistant Collector. He further submits that the application is allegedly made only on 16.05.2026 and without waiting for some reasonable time, petitioner has rushed to this Court by filing this writ petition.
5. This Court is not inclined to grant the relief as prayed for. The writ petition is, accordingly, dismissed. No order as to costs.
