IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.1545 of 2026 Muna Biswal … Petitioner Mr. B.B. Routray, Advocate -versus- State of Odisha … Opposite Party Mr. S.C. Pradhan, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL)23.04.2026 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Capital PS Case No.226 of 2019 corresponding to TR Case No.274 of 2021 pending in the file of learned Adhoc Addl. Sessions Judge, Fast Track Special Court No.II, Bhubaneswar for commission of offences punishable U/Ss. 363/366/376(2)(n) of IPC r/w Sec.6 of POCSO Act. 3. Heard, Mr. Binaya Bhusan Routray, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the present matter and perused the record. None appears for the victim despite having entered appearance through a counsel. 4. Admittedly, this is a bail jump case and the NBWA was issued against the petitioner on 08.05.2021 when he failed to appear before the Court, however, the petitioner was taken into custody on 06.11.2025 on the strength of execution of NBWA and thereby, the petitioner must have felt the rigor of law by remaining in custody for flouting the orders of the Court. In the aforesaid circumstances, this Court by taking a lenient view admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper with following condition:- (i) the petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with. In case the Petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 6. Accordingly, the BLAPL stands disposed of. 7. Issue urgent certified copy of the order as per Rules. (G. Satapathy) Judge Jayakrushna
