... Petitioner.
Mr. Kaushik Choudhury, Mr. Dwaipayan Panda
... For the Petitioner.
Mr. Joydeep Roy, Ms. Eshita Dutta
... For the State.
Learned advocate appearing for the petitioner submits that there is no recovery from the present petitioner, although the subject-matter of the case relates to alleged recovery of 14,798 bottles of Phensedyl. It has also been contended that the petitioner surrendered before the court and is in custody for 2 months 20 days. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the petitioner was in continuous touch with the other accused viz. Narayan Biswas whose vehicle was used for commission of the alleged offence. There are three antecedents of the present petitioner.
2 Having considered the same, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Petitioner would be at liberty to approach this Court after the evidence of seizure list witnesses is over. The application for bail, being CRM (NDPS) 588 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
