Learned advocate appearing for the petitioner submits that from the exclusive possession of the petitioner, 4.005 kgs. of ganja was recovered and the subject-matter of the case relates to 27.635 kgs. of ganja. It has also been submitted that the petitioner is in custody from 21.04.2024. As such, petitioner may be released on bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that all the prosecution witnesses have been examined and the next date has been fixed for examination of the accused persons under Section 313 of the Code of Criminal Procedure.
2 Having considered the advanced stage of the case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 571 of 2026, is, thus, dismissed. Report submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
