Choudhury for the petitioner Akbar Hussain Laskar @ Alom, who has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS for short) with prayer for pre-arrest bail as he is apprehending arrest in connection with NDPS Case No. 47/2026 arising out of Silchar Police Station Case No. 141/2026 under Sections 21(b)/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 Page No.# 2/3 (NDPS Act for short), pending in the Court of learned Special Judge, Cachar, Silchar. 2. It is submitted on behalf of the petitioner that the petitioner was not in the vehicle, carrying contraband, nor he is the owner of the vehicle. On a matrimonial dispute, he has been falsely implicated by his wife, who facilitated the informant to falsely implicate him in connection with an NDPS Case. The vehicle owner was driving the vehicle. 3. Per contra, learned Additional Public Prosecutor Mr. B Sarma laid stress in his argument that charge sheet has been laid against the petitioner as a prima facie case under Section 21(b)/25 of the NDPS Act has been found against the petitioner. The petitioner’s wife was found travelling in the vehicle, carrying the contraband. 4. It is submitted by the learned Additional Public Prosecutor that the argument of the learned counsel for the petitioner that his wife has falsely implicated him, holds no water. 5. I have scrutinized the scanned copies of the Trial Court Records as well as the scanned copies of the Case Diary. As charge sheet has been laid against the petitioner, the petitioner is directed to approach the Jurisdictional Court and apply for bail, which may be considered by the Court in accordance with law. 6.
