Order No.
ORDER 23.04.2026
01.
1. Heard.
2. The petitioners are seeking pre-arrest bail in connection with Kabisuryanagar P.S. Case No.148 of 2021 corresponding to G.R. Case No.147 of 2021 registered for the alleged commission of the offences punishable under Sections 509/ 448/ 354/ 323/ 307/ 506/34 of the IPC, pending in the Court of the learned J.M.F.C., Kabisuryanagar.
3. Learned counsel for the petitioners, on instruction from the petitioners, submits that except the present p. 2 bail application, no other bail application of the petitioners is pending in any other Court relating to the aforesaid F.I.R.
4. Earlier, the present petitioners had approached this Court by filing ABLAPL No.6297 of 2021. The Coordinate Bench of this Court vide order dated 29.09.2021 has already granted the concession of pre- arrest bail to the petitioners.
5.
Learned counsel for the petitioners submits that Manoja Routa, the co-petitioner in the anticipatory bail whose his bail plea was turned down while granting bail to the petitioners, surrendered before the Court below and has been remanded. Therefore, the petitioners are apprehending that once they surrender before the Court below, they may be remanded. The apprehension expressed by the petitioners is unfounded because once the anticipatory bail has been granted to the petitioners, in view of the judgment in the case of Sushila Aggarwal vs. State (NCT of Delhi, reported in AIR 2020 SC 831, the concession remains p. 3 in force during the trial as well. Hence, no order needs to be passed in the present case.
6. In view of the above, the ABLAPL is disposed of.
