The petitioners claim to be the owners of Premises No. 69D, Abinash Chandra Banerjee Lane, Beliaghata, Kolkata – 700010 within ward no.3 of the Kolkata Municipal Corporation measuring about 2 bighas 6 cottahs 6 chittacks. The petitioners approached the authorities of the Kolkata Municipal Corporation for sanction of a building plan for raising a multi-storied building on the said plot of land. The petitioners allege that the authorities of the Kolkata Municipal Corporation asked the architect of the petitioners to bring no objection certificate from the competent authority of the Urban Land Ceiling Department. The petitioners thereafter applied before the competent authority, Urban Land Ceiling Department, Kolkata being the 2nd respondent for
2 issuance of a no objection certificate. The 2nd respondent rejected the prayer for issuance of the no objection certificate by an order dated 4th November, 2025. As rightly argued by Mr. Gupta, learned advocate for the petitioners that the order rejecting the prayer for issuance of the no objection certificate by the 2nd respondent is a non-speaking order. Mr. Mahata, learned Additional Government Pleader submits that the 2nd respondent may be permitted to pass a reasoned order within a time limit that may be fixed by this Court. Heard Mr. Mukherjee, learned senior advocate for the Kolkata Municipal Corporation. As already observed hereinbefore that the order dated 4th November, 2025 is the non-speaking one. Only for such reason the same is set aside. The Urban Land Ceiling Department, Kolkata being the 2nd respondent is directed to reconsider the matter relating to issuance of the no objection certification in faovur of the petitioners and communicate the decision to the petitioners as expeditiously as possible but positively within a period of eight weeks from the receipt of a server copy of this order. In case any adverse decision is contemplated against the petitioners, an opportunity of hearing shall be provided to the petitioners or their authorized representative. 3 With the above observations and directions, WPA 4832 of 2026 stands disposed of.
There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
