The petitioner has sought interim bail for a period of four months in connection with FIR No. 455/2024 registered at Police Station Special Cell, under Sections 8(c)/21/22/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. The application is predicated on medical ground as he has been advised coronary artery bypass graft-CBG surgery. 2. Issue notice. The medical documents annexed with the status report show that the petitioner has been treated at Max Hospital, Saket. His prescription dated 13.02.2026 has been annexed, which records that he came to the hospital with complaint of consistent chest pain and shortness of breath. He requires admission for the aforesaid surgery, but has been advised to report to the hospital on 09.03.2026 after controlling his blood sugar, which was very high. It is also observed that his heart rate continues to be on high side. 4. The petitioner had earlier filed an application for interim bail, which was granted by the Sessions Court for a period of four weeks, by order dated 21.01.2026. However, his application for extension, on the grounds now urged, was rejected by order dated 24.02.2026. 5. Mr. Singh states that the medical documents were verified before the Sessions Court, as recorded in the prosecution’s reply filed before the Sessions Court [Annexure B to the bail application]. 6. A perusal of the medical documents shows that the petitioner has been advised to report to the hospital on 09.03.2026, but it also indicates that the proposed surgery is contingent upon the petitioner’s progress in controlling his blood sugar and upon other parameters. 7. Mr. Varun Deswal, learned counsel for the petitioner, submits that the interim bail may be extended for the present with the caveat that, if the petitioner’s surgery does not take place on or about 09.03.2026, he will surrender forthwith. I am of the view that this suggestion is reasonable. 8. The only ground which appears to have weighed with the Sessions This is a digitally signed order. However, in my view, that is explained by the need to bring the petitioner’s parameters, including the blood sugar, within a range acceptable for surgery. 9. In view of the petitioner’s impending surgery, based upon verified medical documents, the interim bail granted to him by order of the Sessions Court dated 21.01.2026, is extended until 31.03.2026, on the same terms and conditions. This will be subject also to the condition that, in the event, the petitioner’s surgery is not performed by 11.03.2026, he will surrender on 12.03.2026. 10. The petitioner’s wife, who is his parokar, is present in Court. She is directed to communicate the medical record to the Investigating Officer by 11.03.2026, with regard to the status of the petitioner’s surgery. 11. The application stands disposed of.
