Mr. Sanat Kumar Das Mr. Sujan Chatterjee Mr. Rohan Bavishi Mrs. Anuska Bose … for the petitioner This is an application wherein petitioner has prayed for expeditious disposal of GR Case No. 1365 of 2020 presently pending before learned Chief Judicial Magistrate, Barasat, North 24 Parganas. It is submitted on behalf of the petitioner that the instant Newtown Police Station Case No. 95 of 2020 under sections 323/325/326 of the Indian Penal Code was initiated on 25.06.2020. The investigating agency submitted charge-sheet under section 325 of the IPC on 26.07.2020 and the charge was framed against the opposite party no. 2 on 16.02.2022, but since then only examination-in-chief of PW 1 and PW.2 have been recorded. The prosecution proposes to examine six witnesses. Petitioner herein is suffering a lot due to long pendency of the proceeding and as such he prayed for a direction upon the court below for expeditious disposal of the proceeding. Having heard learned counsel for the petitioner, and that the prayer made by the petitioner is innocuous and, if allowed in terms of the prayer made in the petition, the opposite parties will have no cause to prejudice and as such, service of copy of application upon the opposite parties is dispensed with. 2 Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified in terms of the long pendency of the case, the instant application being CRR 37 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding and to make best effort to conclude the trial preferably within a period of six months from the next date of hearing. This order is passed invoking this court’s jurisdiction as envisaged under section 529 of the BNSS.
