Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has assailed the transfer order dated 11.02.2026 (Annexure P-1), Ayurvedic Medical Officer, from G.A.H.C. Raipur Soharan (Una) to G.A.H.C. Kot (Una), in place of private respondent. Reply to the petition has been filed by the private respondent. 2. Learned Additional Advocate General submits that in light of the averments contained in the reply filed by the private respondent, the State will assist the Court on the strength of the same. 3. Heard. 4. The contention of learned Counsel for the petitioner is that the petitioner has been transferred from his present place of posting just after a stay of one year. On the other hand, learned Additional Advocate General as also learned Counsel for the private respondent point out that the petitioner was posted at GAHC 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:5681 Chartgarh, District Una from the month of August, 2021 to 22.01.2025, from where he was posted at AAM Raipur Sohara, District Una and these two stations are just at a distance of less than 3 Kilometers from each other. This fact could not be disputed by the learned Counsel for the petitioner. 5. In light of this fact, this Court does not finds any perversity in the impugned transfer order, as obviously, the petitioner has completed more than four and half years within a vicinity of 3 Kilometers. 6. At this stage, learned Counsel for the petitioner prays that the petitioner be allowed to make a representation to the Authorities concerned for his adjustment. 7.
Therefore, without interfering with the impugned transfer order, this petition is disposed of with the direction that the petitioner may approach the Authority concerned for his adjustment by way of representation and if any such representation is received within a period of two weeks from today, let the same be decided within a period of three weeks as from the date of receipt of the same. Till then, the petitioner shall be at liberty, whether or not to join at the transferred place of posting and can avail the kind of leave due to him. Pending miscellaneous application(s), if any, also stand disposed of. Interim order, if any, stands vacated. (Ajay Mohan Goel)
