1. The petitioner has filed this petition seeking the following reliefs:-
“10.1 That the Hon'ble Court be pleased to call for the entire records in connection of the petitioner's cases. NIRMALA RAO
2 10.2 That the Hon'ble court be further pleased to direct the Respondent authorities to direct the Respondent authorities to grant benefit of promotion from the year 2017 as Senior Scientific Assistant within reasonable period from when he completed 3 years service as per Rules,
2011. 10.3 That the Hon'ble court be further pleased to direct the Respondent authorities to consider and decide the representation of the petitioner for grant of benefit of promotion on the post of Senior Scientific Assistant within limited period. 10.4 Any other order that the Hon'ble Court deems fit and necessary in the circumstances of the case be also passed. 10.5 That the cost of the petition be also awarded to the petitioners.”

Learned counsel for the petitioner would submit that the petitioner was promoted to the post of Senior Scientific Assistant pursuant to
order dated in WP(S) No.9778 of 2019 by the Controller Food and Drugs Administration, Chhattisgarh dated 1.10.2021. He would submit that the petitioner was entitled to get promotion to the post of Senior Scientific Assistant with effect from 3.8.2017, the date on which similarly situated Junior Scientific Assistants were promoted. He would submit that the petitioner entitled for all benefits of Senior Scientific Assistant from the said date. He would submit that a representation was made by the petitioner on 7.12.2021 before respondent No.2 but till date, no decision has been taken. He would contend that a direction may be issued to respondent No.2 to decide the pending representation expeditiously strictly in accordance with law.

3. On the other hand, learned counsel for the State would oppose. He would submit that the petitioner has claimed promotion and other benefits from the year 2017 whereas, this petition was filed in the year 2022, thus, the petition suffers from delay and laches and deserves to be dismissed.
4. I have heard learned counsel for the parties and perused the documents present on record.

Taking into consideration the limited prayer made by counsel for the petitioner, this petition at this juncture, disposed of with a direction to respondent No.2 to decide the pending representation of the petitioner dated 7.12.2021 expeditiously and strictly in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the case.
6. With the aforesaid liberty, this petition is disposed of. Sd/-
