THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER 1. In this petition, petitioners are assailing the Order dated 17.03.2026 in JRB/DAVA/29-C/07/2025-26(Annexure-W) passed by respondent No.2. 2. Sri. Jayakumar S. Patil, learned Senior Counsel appearing on behalf of Sri.Deviprasad Shetty, learned counsel for the petitioners, invited the attention of the Court to the Order dated 23.10.2019 in W.P.Nos.49716-49725/2019(Annexure-A) and the Order dated 24.11.2025 in - 4 - HC-KAR NC: 2026:KHC:22483 WP No. 11204 of 2026 W.P.No.31953/2025(Annexure-R) passed by this Court and submitted that this Court has quashed identical disqualification order impugned therein and therefore, sought for interference of this Court. 3. Per contra, Sri. Yogesh D. Naik, learned Additional Government Advocate submitted that the impugned order at Annexure-W is an appealable order under Section 106 of the Karnataka Co-operative Societies Act, 1959, and accordingly submitted that the petitioners have efficacious remedy before the competent Appellate Authority. 4. In that view of the matter, though learned Senior Counsel submitted that identical order at Annexure-W has been quashed by this Court in W.P. No.31953/2025, however taking into consideration that, in the earlier proceedings also the appeal has been preferred, therein, I am of the view that it is open for the petitioners to approach the competent Appellate Authority as the petitioners are having efficacious remedy under the Karnataka Co-operative Societies Act, 1959, and the Writ Petition cannot be accepted at this stage. - 5 - HC-KAR NC: 2026:KHC:22483 WP No. 11204 of 2026 5. As such, reserving liberty to the petitioners to approach the competent Appellate Authority, the Writ Petition is dismissed. All contentions of the parties are kept.
