Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, this Hon’ble Corut may kindly be pleased to issue a writ/writs, direction/directions, to convene a review DPC, if necessary, and to promote the petitioner to the post of ‘Superintendent’ w.e.f. 09.06.2023, when the junior i.e. respondent no. 6 and 7 have been promoted. 10.2 That, this Hon’ble Court may kindly be pleased to issue a writ/writs, direction/directions, to set aside the promotion order dated 09.06.2023 (Annexure P/14) issue in favour of respondent no. 6 and 7 to the post of ‘Superintendent’. 10.3 That, this Hon’ble Court may kindly be pleased to issue a writ/writs, direction/directions, to set aside the promotion order dated 05.05.2020 (Annexure P/4) issued in favor of respondent no. 6 (junior) to the post of ‘Accountant Superintendent’. 10.4 Grant all consequential benefits, including arrears of salary, seniority, and other allowances, as admissible under the law. 3 / 4 10.5 Direct the respondents to complete the above process within a time-bound period. 10.6 That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner was appointed on the post of Lower Division Clerk in the year 1990, thereafter, he was promoted to the post of Junior Accountant vide order dated 24.09.2013 and now he became eligible for promotion on the post of Office Superintendent. Petitioner was in zone of consideration, his name was also considered, however, based on some false complaint he was not considered and junior to him were promoted. He further submits that subsequently complainant was found to be not correct, however, further steps for passing appropriate order on promotion of petitioner has not been issued. Petitioner thereafter, has submitted representation before respondent no. 4 on 12.06.2024, 19.07.2024 and 28.03.2025 but till date none of his representation has been considered. Therefore, direction be issued to respondent no. 4 to consider and take decision on representations submitted by petitioner at the earliest. 3. Learned counsel for State submits that as petitioner is not pressing this writ petition on merits and is only seeking direction to respondent no. 4 to consider and take decision on representations submitted by petitioner, he is having no objection to the limited prayer. 4. On due consideration of submission made by learned counsel for the respective parties, nature of grievances raised in this writ petition and 4 / 4 also considering the limited prayer made by learned counsel for petitioner, I find it appropriate to dispose of this writ petition at this stage, directing respondent no. 4 to consider and take decision on representations submitted by petitioner dated 12.06.2024, 19.07.2024 and 28.03.2025 Annexure P-20, in accordance with law, expeditiously, preferably within a further period of 02 months from the date of receipt of the Order. 5.
